Spansion Statement on ITC ruling on Spansion and Samsung Litigation

Last Updated: October 22, 2010

The ITC (International Trade Commission) has issued an initial determination in a patent infringement case filed by Spansion against Samsung.  According to the initial determination by ITC Judge Charles E Bullock, Samsung did not infringe Spansion patents.  Before a final determination is issued, the judge's decision must be reviewed by the full International Trade Commission, an independent body that considers import damage to U.S. industries. A target date for completion of that review is Feb. 22, 2011.

Spansion Statement:

We are disappointed in the judge’s ruling.  However, this is only a first step in the decision process.  We will continue to fight any violations of our  patents to defend  our investment in technology.   We filed four additional patent infringement lawsuits against Samsung in August 2010.  For the case filed in the ITC, the ITC recently announced an investigation into whether manufacturers of downstream products such as cell phones and music players have infringed on certain Spansion patents.
